Birth registration is compulsory in every country. It’s your first right and a step towards setting up your identity. Once you have it, obtaining a security number, applying for a passport, registering in schools, getting a license, and applying for some government facilities is easy.

Why do you need the birth proof?

A birth proof is legal proof of one’s nativity, which ensures that the bearer is authentically able to have the facilities granted by the government. These facilities cover the right to have healthcare, education, protection, inheritance, and the record of existence availed to natives only.

The right to have inheritance refers to a legal claim over the property. With legitimate birth proof, one can easily prove that the fixed asset belongs to him/her. This document reads the name of guardians or parents, which proves that the property is legally his, or hers.

Further, this document is treated as a record of existence, which is necessary to show when it comes to proving one’s actual identity. Let’s say, a child is separated from his family due to a natural calamity. The authorized person like a police officer or sergeant needs the proof to recognise& reunite him with his family.   

How can NRIs apply for the birth certificate in India?

Non-residents can also apply for this certificate for their children, even if they are born in a foreign. This is possible, given that they have no dual citizenship. India does not validate this practice. The applicant has to give up his foreign citizenship.

Before applying, one has to understand the eligibility criteria.

Here it is.

  1. Eligibility Criteria

These guidelines are also necessary for the birth certificate for NRIs.The applicant is entitled to the application of a birth certificate if he/she meets these conditions.

•             He or she should be a citizen of India or an NRI, born within the territorial jurisdiction of India.

•             He/she shouldn’t have any birth certificate issued from any other government agency anywhere in India, or abroad.

•             There should be a gap of a minimum of one year between the date of birth of the applicant and the date of application for registering the birth.

  • Supporting Documents

There should be some supporting documents enclosed with the application form. These should be valid and authentic. The civil body, especially Municipal Corporation (MC), verifies them.

These are segmented into different categories of proof.

  • Identity proof of parents: This is applicable if the applicant is a minor and parents are applying on his/her behalf. Any of these documents would be enough to verify the parents’ identity.

•             Aadhar card

•             PAN card

•             Voter ID card

•             Passport

•             Ration card with photo

•             Driving license

•             Any Govt. recognized document like attested affidavit

  • Identity proof of beneficiary:  This is for all applicants to show up their identity registered in any of these documents:

•             Aadhar card

•             PAN card

•             Voter ID card

•             Passport

•             Ration card with photo

•             Driving license

•             Any Govt. recognized document like attested affidavit

•             The letter from the School Principal (on letterhead) or school ID card (in case of minors)

  • Recent address proof of beneficiary/parents: This is applicable in the case of minors.

•             Aadhaar card

•             Bank passbook

•             Telephone ill(Landline or Postpaid)

•             Voter ID card

•             Ration card

•             Electricity bill

•             Gas bill

•             Driving license

  • Permanent address proof of beneficiary/parents: this is again the case of the minor’s birth registration. You should have any of these to show up for verification.

•             Aadhaar card

•             Passport

•             Bank passbook

•             Telephone ill(Landline or Postpaid)

•             Voter ID card

•             Ration card

•             Electricity bill

•             Gas bill

•             Driving license

•             Rent agreement (Registered)

•             Water bill

  • Date of birth proof of beneficiary

•             Aadhaar Card

•             Passport

•             Nursing home/Hospital Report/Vaccination card Driving License

•             Any recognized board / Doctor Report

•             Certificate from school attested by the principal on school letterhead

  • Place of Birth Proof

In this case, the address proof of parents would be considered. The proofs mentioned in (c) section would be appropriate to enclose. In the case of the birth happening at the hospital, the nursing home/hospital report will be considered as proof of place of birth.

  1. Affidavit: It is a sworn document that is attested by the A-gazette officer.  It can be drafted on a non-judicial e-stamp paper as per the prescribed format in Annexure I.
  2. One passport size colored photograph of the beneficiary :

•             The size of the photograph would be 5cm x 4.5cm Or 2”x1.75”.

•             It should cover the full face. The front view and open eyes should be there in it with a plain white or off-white background. The expression should be the natural expression.

•             It should cover the full head from the top of the hair to the shoulder. There shouldn’t have any shadows on the face and the background.

•             Avoid putting on any sunglasses or hats for the picture.

More Things to Remember

•             It should be any parents /legal guardians who can only apply on behalf of a minor(“minor” is defined as per the provisions of the Indian Majority Act, 1875)

•             In the case of a minor, the parent’s Address proof has to be there as the beneficiary’s address. The ID proof and date of birth proof must be of the beneficiary, whether he/she is minor or otherwise.

•             The beneficiary’s self-attested copy of the original documents is to be presented while applying directly at the municipal corporation. In the case of online applications, documents are to be uploaded in e-District application software.

•             There may have the requirement of physical verification of some documents even though you have applied online.

•             You must upload the scanned copy of the original affidavit while applying online. Submit original affidavit to the concerned SDM/Tehsildar/CSC physically or send it by registered / speed post. Enclose the Application Acknowledgement number with it.

•             The beneficiary himself/herself /any of his family members should be there at the birth registration center for photographs. Or, you may submit his/her photograph. In the case of an online application, you may upload the beneficiary’s photograph.

•             Upload the scanned copy of self-declaration while applying online. Submit the hard copy of the declaration to the concerned SDM/Tehsildar/CSC in-person or by speed post/registered post along with the application.

Summary

The birth certificate can be obtained from the local civil authority directly or over the internet. NRIs can register their birth by enclosing all requisite documents together with online application. There are official online platforms where one can easily apply and upload documents to verify for your birth proof.
